ISU Associate Athletic Director of Athletic Communications Tom Kroeschell told the Iowa State Daily: “While Albert Gary has gone through this stage of the legal process, he still must go through the university judicial process. Coach Rhoads will comment further when that process is complete.”
ISU wide receiver Albert Gary was sentenced Monday to three years probation and a $2,000 fine on two felony charges that stemmed from a June 2011 incident.
Gary was originally charged Nov. 15 with first-degree robbery, a class B felony, after ISU Police responded to a call from a man claiming to have been robbed at gunpoint on Central Campus on June 19.
Gary pleaded guilty to charges of first-degree theft on April 16, a class C felony, and going armed with intent, a class D felony. Gary could have been sentenced to a maximum of 15 years in prison.
The plea agreement with the state recommended Gary be given a suspended sentence on both felony charges, pay approximately $2,000 in fines and court fees, spend time at a residential facility and face no more than three years of probation.
District Court Judge Timothy Finn officially handed down that sentence on Monday.
Four others were involved in the incident on June 19, including Devondrick Nealy, Aaron Horne, Quinton Pompey and Duran Hollis, according to police reports.
ISU football coach Paul Rhoads suspended Gary for the first three games of the 2011-12 season for “his actions and lack of judgment,” adding that the team would continue to let the legal process work.
