Former ISU wrestler arrested, put in a headlock by OWI charge

Zach Roberson, a former ISU wrestler, is facing an OWI charge, a serious misdemeanor, after being arrested for driving while intoxicated in the early morning hours of May 6.
Roberson is set to have a pre-trial conference Monday afternoon with the Story County attorney’s office.
Stephen Holmes, Story County attorney, said the pre-trial conference is a meeting between the defendant, their attorney and the prosecutor.
“This is simply an opportunity for the defendant and their attorney to meet with the prosecutor to see if they can reach a plea agreement,” Holmes said. “The pre-trial conferences are automatically set up in all indictable misdemeanor cases with the idea of reaching a plea agreement.”
Holmes said in most cases, prosecutors offer pleas because it is in the defendant’s best interest to plea out.
Holmes said since this is Roberson’s first offense, he could receive a deferred judgment. In order to be eligible for it, Roberson needs to have had a blood alcohol level under 0.15 — his was 0.136 — no other OWI offenses and no accidents as a result of his intoxication.
The court may instead impose a sentence if it sees fit, Holmes said.
Roberson could receive a mandatory minimum sentence of two days in the Story County jail and a mandatory minimum fine of $1,000.
With the deferred judgment, Roberson would be placed on probation, Holmes said.
With the probation, Roberson would be required to participate in a substance abuse class, take a drinking and driving course and perform community service. The charge will be expunged from his record if he successfully completes his probation.
Holmes said Roberson might have to get an ignition interlock device installed on his car that would require him to blow into it to test his breathe before the car will start.
