Berryman plea again declined
January 24, 2005
Former Cyclone football player Jason Berryman’s second request to reduce his sentence was denied, but he still has a chance to be released earlier than planned.
Stephen Holmes, Story County attorney, said because Berryman is in county jail, the sheriff’s good behavior policy is applicable.
If Story County Sheriff Paul Fitzgerald recommends Berryman be released early for good behavior, the policy allows a 10 percent reduction for good behavior and an additional 10 percent if the prisoner works in jail.
Berryman wrote a letter to Judge William Pattinson on Dec. 31 asking to be released early from his sentence.
The letter stated that Berryman was sorry for what he had done and had learned a lesson.
He was sentenced to 300 days in jail after pleading guilty in court to serious misdemeanor assault and felony first-degree theft for an incident on Aug. 4, 2004.
Berryman punched an ISU student and stole $4 from him and then stole a cell phone from another student.
