Student sentenced for child porn

An ISU student who was found in possession of child pornography last October received a suspended sentence of probation not to exceed 18 months Wednesday.
Nicholas Burch, freshman in mechanical engineering, pleaded guilty to one count of sexual exploitation of a minor, an aggravated misdemeanor, in December. Burch was originally charged with three counts of sexual exploitation of a minor.
Burch, 2353 Larch Greene, could have received up to two years imprisonment and a $5,000 fine, but received probation in exchange for the reduced charges.
“Mr. Burch is a young individual,” said Judge Thomas Hronek. “He unfortunately involved himself in possession of contraband.”
Hronek spoke to the court of the victimization of children in reference to the images found on Burch’s computer.
“[This is] not showing that Mr. Burch was involved in the initial victimization of the child [and] not to say he intended to participate in a prohibited act with a child. I believe Mr. Burch is truly sorry,” he said.
Burch must also register as a sex offender with the Story County Sheriff’s office within 10 days of sentencing and must attend sex offender treatment. He is not allowed to have contact with any persons under the age of 18.
Burch was arrested Oct. 13, 2003 after ISU Police found images on his computer of minors engaged in or subject to sexual activities.
Burch’s state-appointed attorney, assistant public defender Sarah Livingston, said Burch had no idea he was sharing the images on the ISU network. This does not make the possession acceptable, however, she said.
In a short statement made to the court Burch expressed his regret. “I would just like to say I’m sorry for this mess,” he said.
Hronek said his main worry is for the community, as well as Burch’s rehabilitation.
“[The images] not only appeared on Mr. Burch’s computer but elsewhere,” he said.
