State requests continuance for Lozano’s juvenile hearing

The juvenile hearing to determine whether Tim Lozano will be tried as an adult has been postponed for a second time, but on this occasion by the prosecution.

Lozano is accused in the death of Linda Chittenden, who died when the vehicle Lozano was driving failed to stop at a posted stop sign.

Lozano is charged with vehicular homicide, involuntary manslaughter and fleeing the scene of the accident.

Stephen Holmes, Story County attorney, said the continuance was filed because a key witness could not be present.

The state filed for a continuance after discovering Detective Dave Konopa of the Ames Police Department would not be available to testify at the hearing scheduled for July 21.

Assistant Story County Attorney Richard Early would also not have been able to attend.

The hearing has been rescheduled for Aug. 1 at 9:30 a.m.

Continuances are routine, Holmes said.

“The passage of time is not so great to worry about people’s recollection being lost,” Holmes said.

The hearing was originally scheduled for June 16, but was delayed until July 21 after the defense attorney Adria Stonehocker asked for time to have a psychiatric evaluation performed on Lozano.

According to court documents, the juvenile detention center in Eldora had Lozano examined on May 31 at the recommendation of a nurse.

“Since the minor child’s placement at Central Iowa Juvenile Detention Center,” stated court documents, “the child has complained of headaches, neck and back pain, of hearing voices in his head and of hallucinations.”
