Lozano hearing postponed for July
June 16, 2003
The hearing scheduled for Tim Lozano, charged with vehicular homicide, involuntary manslaughter and leaving the scene of an accident, will be postponed until July 21, pending a doctor’s exam.
Lozano, 15, is accused of killing Linda Chittenden in a hit-and-run accident which occurred May 18.
Lozano was traveling more than 50 mph in a Volvo when he ran a stop sign, hitting Chittenden’s Ford Contour.
Police responded to the accident at 10:42 p.m.
The hearing was scheduled to determine whether or not Lozano could be tried as an adult.
Adria Stonehocker, Lozano’s attorney, said she filed a request for Lozano to be evaluated physically and mentally after prosecutors filed a waiver to move Lozano’s trial to adult court.
Her request was made to ensure the court has all the information possible regarding Lozano’s state so an appropriate decision can be made.
The hearing was rescheduled to 9:30 a.m. July 21.
Lozano is facing up to ten years in prison if he is charged with vehicular homicide and five years if he is charged with manslaughter.
