EDITORIAL: Juvenile court no place for Lozano
May 26, 2003
On May 18, a car full of juveniles caused an accident that took a woman’s life. The driver of that car, Tim Lozano, 15, is charged with vehicular homicide, involuntary manslaughter and fleeing the scene of an accident.
On May 20, the Story County Attorney’s office filed a juvenile detention form requesting a hearing to waive Lozano from juvenile court and prosecute him as an adult.
Lozano made decisions leading to the accident which broke several laws. He only had an instruction permit, which requires the driver to be supervised by a licensed driver at all times. Lozano was not.
Secondly, Lozano was driving in excess of the speed limit. The accident occurred in a residential area where the posted speed limit is 25 to 35 miles per hour. The estimated speed of the vehicle was well over the limit.
Lozano also has a prior criminal record in Idaho.
Justice will be served only if Lozano is tried as an adult with tougher punishments than the juvenile court may provide.
