Students charged with willful injury in fight

Three ISU students have been arrested and charged with willful injury after an assault near the Friley Hall depot on Feb. 2.
Thomas Elliot, freshman in pre-architecture; Kevin Unger, freshman in zoology; and Stuart Garner, freshman in pre-business, were charged Thursday with willful injury after Justin Faust, freshman in liberal arts and sciences, was sent to the hospital with multiple injuries.
Willful injury is a felony charge.
ISU Police Capt. Gene Deisinger said a person is charged with willful injury if an unprovoked attack with the intent of injury occurs.
Unger and Elliot have been released on a $25,000 bond. Garner was released on a surety bond. All three have a preliminary hearing set for 1 p.m. Friday at the Story County Courthouse in Nevada.
Deisinger said ISU Police received a call from a hall director asking police to respond to a fight involving four or five people at about 2:20 a.m. on the morning of Feb. 2.
When officers arrived on the scene they saw people running into Friley and Helser Halls. Officers found Faust, who believed he had broken his jaw, and requested an ambulance.
Faust said he was taken to Mary Greeley Medical Center, where he remained until Tuesday afternoon.
He said his jaw was broken in two places, his nose was broken and a bone behind his eye was broken.
Deisinger said ISU Police do not know what prompted the fight.
Faust said he could not remember exactly what started the fight either.
“They started it, but I don’t remember the exact words,” he said.
Elliott and Unger declined to comment about the incident, and Garner could not be reached for comment.
“It appears there was some sort of verbal altercation between Mr. Faust and another man that at some point escalated into a physical confrontation,” Deisinger said.
Deisinger said ISU Police conducted interviews and an investigation to determine what happened the night of the assault.
“Officers have interviewed all the parties known to be present. Based on the statements made by those people and witnesses, officers have made a determination about who provoked the fight,” Deisinger said.
Unger, Garner and Elliot were processed at the ISU Police office on campus and then transported to the Story County Justice Center in Nevada.
