GSB court rules in favor of Larson
April 26, 2001
Government of the Student Body Chief Justice Alex Olson ruled that Jenny Larson will remain Richardson Court Association president. The decision was announced Thursday night.
Olson said he agreed with Associate Justice Steve Skutnik’s written opinion for Larson and GSB Rules Committee v. RCA Student Government, which said, “. the six infractions levied against Ms. Larson and Ms. [Jennie] Kingery were baseless in the respect that no standing law provided for them, henceforth it is the decision of this member of the Arbitration Board that these charges be overturned and by such, the disqualification of the Larson/Kingery slate be overturned.”
Larson said she believed the verdict was reasonable and the integrity of the election had been upheld.
“The voice of the residence halls were heard,” she said. “This sets a very good precedence for fair elections in the future.”
On April 9, the RCA election commission ordered the removal of Larson and Kingery on the grounds of illegal campaigning. Defendant Andy Walling, former RCA president, said they had posted campaign posters next to computer labs in Maple Hall, which was against the election act passed six hours before the April 3 elections.
On Wednesday, the Arbitration Board heard arguments from both the plaintiffs and defendant.
Tony Luken, a plaintiff in the case, said Larson should be able to hold her position of president because she had won the majority of the votes.
“We’ve shown this time and time again,” he said. “The votes are sound and not compromised. The will of the electorate of RCA has already been established. By Iowa Code, you can’t take that away from them.”
Andy Walling agreed with the plaintiffs and blamed the problems on his election committee’s lack of experience.
“A lot of things went wrong that shouldn’t have,” he said. “There is no defense besides that we screwed up. We recommend that [the Arbitration Board] at least consider the idea of throwing out violations.”
