Student to receive vandalism sentence
January 8, 2001
An ISU student accused of vandalizing the “Ring of Life” sculpture in MacKay Hall will be sentenced today.Nick Johnson, senior in management information systems, pleaded guilty to criminal mischief in the third degree. Johnson was accused of the class C felony for his connection to the stolen child-statue head from the Christian Petersen sculpture on Sept. 14, said Steve Holmes, prosecuting attorney.Another student, Quincy Jones, junior in construction engineering, pleaded not guilty to charges of first-degree criminal mischief and theft regarding the stolen statute head. He will stand trial later this month, said Loras Jaeger, director of the Department of Public Safety. The statue’s head was found Sept. 19 in six pieces in LeBaron Hall’s first-floor men’s rest room.Johnson faces three possible sentences at the 2:30 p.m. hearing in the Story County Courthouse, Holmes said. The court could defer judgment, Holms said, and if Johnson cooperates he could avoid having a criminal record after probation.”[Johnson] could be put on probation,” he said. “If he does everything he’s supposed to do, then the case is expunged.”Two other possible sentences the judge may also impose would be to suspend the sentence if Johnson follows the probation conditions or to convict Johnson, Holmes said. If the judge convicts Johnson, he could face up to 10 years in prison, Holmes said. Both of these sentences include a potential fine of up to $10,000 for Johnson, Holmes said. Johnson also could be ordered to make restitution as part of any three sentences through activities such as going to counseling or performing community service.Neither Johnson nor his lawyer could be reached for comment.
