Judge denies requests in newspaper case

The last of the Story County District Court case pitting Partnership Press, owner of the Ames Daily Tribune, The Campus Reader and The University Times, against the Iowa State Daily Publication Board has been handed down from Judge Kurt L. Wilke, but relatively little has changed.

Both sides filed motions for enlargement with Wilke in order to clarify the decision he made on the case March 21. In the decision, Wilke determined the Iowa State Daily is a governmental body and is subject to Iowa’s open records and open meetings laws.

One motion for enlargement from the ISU Daily Publication Board asked Wilke to be more specific in citing Iowa law in the earlier decision.

Wilke denied requests to clarify his decision except one request from Partnership Press, which Wilke ruled the ISU Daily’s advertising budget is an open record.

In May, Wilke ruled the Iowa State Daily is not responsible for paying lawyer fees for Partnership Press, stating employees at the Daily were acting in “good faith” with the existing body of law.
