Mitchell case moves forward
November 19, 1996
The preliminary hearing for suspended black student security officer Deantrious Mitchell was waived Monday morning.
A Story County judge found probable cause for filing charges against Mitchell without extended court action.
Mitchell will be arraigned soon on the charge of filing a false report, a serious misdemeanor which carries a maximum $1,000 fine and up to one year in prison.
On the morning of Oct. 18 Mitchell claimed he was assaulted near Clyde Williams Field by eight white men. He said the men cut him on his face and arms and uttered racial epithets including the word “nigger.”
On Nov. 4, Mitchell confessed to lying about the incident to Iowa State Department of Public Safety officers after State Medical Examiner’s Office officials concluded Mitchell’s cuts from a razor were self-inflicted.
The incident captivated the Iowa State campus, throwing race relations into the spotlight.
Ron Sotak, an attorney with the Story County Attorney’s Office, said an arraignment is near. Mitchell will enter a plea of “guilty” or “not guilty” at the arraignment unless he works out a plea-bargain with the county attorney’s office.
“I would anticipate the arraignment for next week or the week following,” Sotak said.
Preliminary hearings are scheduled in most cases but probable cause is often found without a hearing.
