Forgetfulness led to former ISU football player’s arrest

According to a former Iowa State football player, a heavy case of forgetfulness created some serious trouble.

Mickal L. Horacek, 22, of 4124 Harris Ave., was arrested on two warrants for fourth degree theft and a parking violation on Monday, April 8.

However, the source of the arrest began last October, Horacek said, when he received a $168.25 scholarship check from the ISU Athletic Department, which he then misplaced.

Days after reporting it lost or stolen, ISU issued him a replacement check. Horacek said he cashed this check at Hy-Vee, 3600 Lincoln Way.

“In January, I was cleaning up my room when I found the original check,” he said. “It didn’t occur to me that this was the scholarship check until much later.”

Horacek said he then cashed the original check at Hy-Vee on Jan. 28.

“About a week later a letter from the police said that I had double-dipped, or cashed two checks that were the same. I was still fuzzy about the whole situation, but the more I thought about it I realized what I had done,” he said. “The police told me I had to pay them [Hy-Vee] back, so I made arrangements to pay $168 restitution to Hy-Vee on Feb. 29,” he said. “

Horacek said it was about a three-week period from the time he cashed the original check to when he planned to pay back Hy-Vee.

Horacek failed to pay Hy-Vee on time, and the Ames Police Department arrested him on April 8 on a warrant for fourth-degree theft in addition to a warrant for an overdue parking ticket.

He was released by the Ames Police Department on a $1,200 bond.

Horacek, who is a senior in history, played his final season with the Cyclones last fall as a wide receiver.
