Palo, Cruise’s attorneys challenge charges

ISU basketball player Bubu Palo’s attorney, along with Spencer Cruise’s attorney, have challenged the second-degree sexual assault charges against the two by asking the state to specify how either of them aided or abetted the other, according to the Ames Tribune.
Yempabou “Bubu” Palo and Spencer Cruise, both 21, were in court on Monday before Judge Dale Ruigh. They asked for a bill of particulars, which is a document from the prosecutors that cites how either Palo or Cruise helped the other in allegedly sexually assaulting a woman last May.
Second-degree sexual assault, a class B felony, is punishable by up to 25 years in prison. In order to be charged, a weapon or threat has to be used during the assault, or the victim has to be 12 or younger, or that it is aided and abetted by one or more persons and committed against the will of the alleged victim.
Palo and Cruise have both pleaded not guilty to two counts each of second-degree sexual assault. Palo’s trial has been set for 9 a.m. on Tuesday, Nov. 27. Cruise’s case is set for 9 a.m. on Tuesday, Dec. 11.
