Brown enters plea in district court

Former men’s basketball assistant coach Randy Brown pleaded not guilty to one count of receipt and one count of possession of images containing minors engaging in sexually explicit conduct in U.S. District Court in Des Moines Monday.

Brown’s attorney, Timothy McCarthy, said Brown’s family and friends attended the arraignment in support of him.

Brown’s trial could begin on May 5 or any time in the two weeks after, McCarthy said. McCarthy anticipates the trial may be pushed back because Brown continues to receive unspecified medical treatment at an undisclosed location.

“He is under a doctor’s care,” McCarthy said.

McCarthy said it is too early to tell whether plea agreements will be reached. “We are going to take a look at the evidence the government has and proceed from there,” he said.

If convicted, Brown could face up to five years in prison on the possession charge and up to 15 years for the receipt, according to the United States Code, Title 18, Section 2252.

Brown was indicted by a federal grand jury on the charges March 11.

According to an affidavit filed by U.S. Postal Inspector Kevin Marshall, a search of Brown’s home and office Jan. 24 produced disks containing images of minors engaging in sexually explicit conduct.

According to the search warrant filed by ISU Police Officer Aaron Delashmutt, ISU Police was contacted by both the U.S. Postal Inspection Service and the National Center for Missing and Exploited Children about an adult male soliciting sex from whom he believed to be a 15-year-old female.

The Internet protocol address was later linked to Brown.
