Cy’s Roost license in jeopardy

Cy’s Roost is awaiting a state judge’s decision as to whether the bar will lose its liquor license for supplying minors with alcohol and bootlegging.

Patrick Green, owner of Cy’s Roost & Don’s Deli, 121 Welch Ave., and Lost & Found Lounge, 121 1/2 Welch Ave., and his attorney, Dan Gonnerman, defended the bar’s citation Wednesday for selling alcohol to a minor in July.

Judy Parks, Ames’ assistant city attorney, has been representing the city in attempts to have Cy’s Roost & Don’s Deli’s license revoked.

She said because of previous violations, Cy’s Roost & Don’s Deli could have its license taken away.

“We had seven violations within the last two years,” Parks said. “Two years is the time frame within [which] alcoholic beverages can be considered past violations.”

The city currently is waiting to hear what the state decides about the bar’s license, Parks said. The Administrative Law Judge, the judge overseeing the case, is Margaret LaMarche.

Parks said LaMarche, who could not be reached for comment, is looking over all of the evidence.

LaMarche will write up a decision as to what the consequences will be as soon as she makes a decision, Parks said.

“I’d like to think that [the bar will lose it’s license] . We put everything into evidence that we needed to have the license revoked,” Parks said.

There also would be a restriction against the selling of alcohol at the specific location of Cy’s Roost & Don’s Deli, meaning Green, or any other future owner of the location, would be prohibited from selling alcohol on the premises for one year, Parks said.

Green was not available for comment.

If Cy’s Roost’s liquor license was revoked, Green still would be able to keep the establishment open, she said.

“[Green] could sell food and non-alcoholic beverages, but not alcohol,” Parks said. “It will be his decision as to whether he wants to keep the business open.”

Andrew White, owner of the Tip Top Lounge, 201 E. Lincoln Way, and Paddy’s Irish Pub and Sips, 124 Welch Ave., said he is supposed to take over ownership of Cy’s Roost & Don’s Deli.

White said he is unsure of when he will take over, because he and Green are waiting for the decision of the state regarding the citation. The city won’t decide whether to revoke Cy’s Roost & Don’s Deli’s liquor license until the state makes a decision about the latest citation, White said.

“We can’t do anything until they make their decision,” he said.

“He’s asked for some help in consultation, and it’s still his business . As far as my involvement, I’m waiting to find out what is happening at the state level.”

Curt Uhde, junior in communication studies and manager at Cy’s, said he had no comment until the case is over.
